Terms and Conditions

ALL SALES ARE FINAL ~ NO REFUNDS OR RETURNS. Buyers must pay for sale items by 3:00pm the day of sale. All items are sold "AS IS, WHERE IS."

No Assumption of Liability. Arizona State University does not assume any responsibility for injury to anyone or damage to any property which results from removal of the property from university premises, any future use of the property, or the condition of any property sold at this sale.

No Warranty. Arizona State University does not provide a warranty for the property purchased and there is no implied warranty of merchantability or fitness for a particular purpose. Arizona State University shall not be responsible for any indirect or consequential damages of the buyer or its agent(s) in connection herewith, such as loss of production, loss of anticipated savings or anticipated profits, or damages of any third party asserted against the buyer. The purchaser and/or its agent agrees and understands it must determine the condition of the sale items.

Proper Disposal of Property and Certification. Buyer and/or its agent understand and agree that all property purchased from Arizona State University must be disposed of according to applicable local, state, and federal laws. By signing the acknowledgment below, bidder and/or its agent certifies that it will comply with all applicable laws in the disposal of purchased property.

Indemnification. The purchaser or its agent named and signing below acknowledges that it shall indemnify, defend, and hold harmless the Arizona Board of Regents and Arizona State University from any and all claims, demands, suits, actions, proceedings, loss, cost, and damages of any kind, including attorneys' fees and litigation expenses, which may be brought or made against or incurred by Arizona State University on account of loss of or damage to any property or for injuries to or death of any person resulting from bidder's removal or use of the property or arising out of the performance of this agreement. This indemnification extends to the proper disposal of property. The purchaser is solely responsible for removal of property from ASU Surplus Property, including any services rendered by third-party shipping companies. Arizona State University may not be listed as the shipper, the purchaser is the shipper when dealing with third-party shipping services.

Method of Payment: Payment is accepted during sale hours. Accepted forms of payment include cash, money order, cashier’s check, or Visa/Master Card. Sales tax is added to the sale at a rate of 6.3 percent. For resale purchases, a valid resale tax license must be supplied to the ASU Surplus Property, along with the completed tax forms and copy of the license.

Removal of Purchased Property: All purchased items must be removed by 3:00 PM two business days after the transaction. Items not removed within this timeframe will be subject to forfeit or storage premiums at the discretion of the customer. Customers wishing not to forfeit their items must notify Surplus Property staff within the two business days timeframe of when the items will be removed. All items not removed within the timeframe without notifying Surplus Property of intent to pickup will be forfeit. Storage premiums are calculated as 5% of the total purchase receipt, not solely the item, per business day stored. Repeated failure to remove purchased items without proper notification of intent to remove will result in prohibition of purchasing from Surplus Property.

Selling awarded items amongst customers is not allowed on Arizona State University property. Arizona State University has the right to withdraw items from the public sale and to refuse any/all bids. Failure to pay for awarded items may result in being banned from participating in future Arizona State University sales. Loading, shipping, and packaging of awarded items is the responsibility of the successful bidder. Bid rigging is not permitted.

As soon as you become the winning bidder at auction, you are responsible for the items purchased even if you have not yet paid for them. You are advised to guard against theft, loss, and breakage.
